As agreed you were lucky to be playing against sporting honest opponents. It can be difficult at times to tell if it was your toucher or another of your woods that ended up in the ditch.
As I understand it the rule also works the other way, if a wood has chalk on it and it isn't a toucher it has to be cleaned or nominated a non toucher before the next bowl comes to rest!

what if jack is in the ditch and 2 of the 3rds bowls are on the edge of the ditch or relatively close,one of the 3rds bowls is a toucher as it was his bowl that pushed the jack into the ditch,the toucher cant be chalked as it may fall if touched and no spray chalk available,the skip wants to push the toucher into the ditch to get the 1st shot and nominates he is going to try this and asks the opposing skip/3rd if its ok to chalk the non toucher to tell the differance between toucher and non toucher if both bowls are pushed into ditch,
i have done this before without any objections from opponents but is it legal????? |

Why wouldn't you just nominate the toucher that is on the ditch edge then chalk it if it is eventually knocked, or falls, into the ditch.

Provided both skips agree, it seems eminently practical to me, even though "it's not legal". Then if the unmarked one falls in you can remove the chalk just as if it had been inadvertently delivered with chalk in the first place.
